Can I own more than own franchise brand at the same time?
Theoretically, it is possible for a franchisee to own more than one franchise brand. However, in practice it is likely to be problematic. The provisions of the franchise agreements should be the first reference point for any franchisee considering operating more than one brand. Many franchise agreements will include a provision requiring that a franchisee dedicates their full time and attention to the operation of the franchise. A franchisee will need to consider whether they have the time and resources to be able to comply with such a provision if they are also trying to establish an additional franchise brand. In addition, most franchise agreements will contain a provision prohibiting a franchisee from engaging in a business that competes with the franchised business. This provision will restrict a franchisee from entering into an additional franchise agreement with a brand that its existing franchisor believes is a competing business, and so unless the two franchise brands are complementary or completely different, or the existing franchisor explicitly agrees to its franchisee operating the additional brand, it is unlikely a franchisee will be able to operate a second franchise brand without breaching the terms of the existing franchise agreement.
