Do all franchise solicitors have to be British Franchise Association members?
Whilst it is not a legal requirement that a solicitor advising on franchising matters must be affiliated to the bfa, it may prove beneficial. A bfa-affiliated solicitor will be familiar with the issues that currently face either a franchisor or a franchisee and will be able to provide advice as appropriate on what is perceived as ‘industry standard’ when it comes to the provisions of a franchise agreement. An affiliated bfa solicitor will also have a good knowledge of other franchiseconnected issues, including property issues, particularly in relation to retail franchise concepts, that a non-franchise specialist lawyer may not be aware of. A bfa-affiliated lawyer will often have through its association with the bfa, formed various contacts with other professionals within the franchise industry, including banks, accountants and consultants, and so may be able to provide additional assistance to potential franchisors and franchisees.
