Who is responsible for selecting the site for my franchise?
Almost always the franchisee picks the site. On rare occasions franchisors may require franchisees to operate from sites they have selected. This normally only applies to high-cost franchises where specific sites are rare and which the franchisor obtains on behalf of its franchisees because the franchisor has access to sites that are not available to franchisees. Ultimately, it will be for the franchisee to decide whether a site is suitable, but many franchisors want to be involved in the process because they often have access to a much broader range of potential contacts and they have the experience as to which sites work, so many franchise agreements require franchisors to be actively involved in the process. Some go further and give the franchisor the right of approval. Even in such circumstances, the franchise agreement will usually specifically provide that the franchisor is not responsible for site selection. If premises are important in a franchise, then it is important that a franchisee does not commit to open within a short period of time if premises have not been found, because it can often be difficult to find suitable premises and acquiring them is usually lengthy.
